California Domestic Violence Restraining Orders (CLET)

The domestic violence laws in California provide protection for married persons, unmarried couples living together, and individuals involved in dating relationships with the ability to obtain both temporary and permanent restraining orders. A same-day temporary restraining order can be granted with a hearing usually scheduled three weeks later for a permanent order. These orders are extremely serious matters, often carrying criminal implications for the perpetrator if domestic battery charges are also filed. Once granted, the order goes into the statewide police system, and the restraining order will come up any time your name is drawn from the system. Additionally, perpetrators can expect the court to order up to 52 weeks of participation in a domestic violence prevention program.
